Alachua County STR Rules 2026: Gainesville Leases

Alachua runs on 12-month student leases with six football weekends on top. Those two models sit on opposite sides of the 6-month transient tax line.

Quick answer: Alachua County has two rental economies and the line between them is the 6-month transient tax threshold. A 12-month student lease sits entirely outside the tourist tax, the state transient sales tax and the vacation rental licence. A handful of football weekends puts the same property fully inside all three. The county levies 5%, collects it itself, and Airbnb remits it for Airbnb bookings only.

Two models, one threshold

The threshold is 6 months, and almost the entire Gainesville rental market sits on the safe side of it by default. A property let on a 12-month written lease to students carries no tourist tax account, no monthly return, no state transient registration and no vacation rental licence.

That is not a loophole. It is the ordinary residential tenancy the statute is written around, and it explains why an owner can hold rental property in this county for years without ever encountering the vacation rental regime.

The moment that changes is the moment the property is let for periods of 6 months or less. And in this market the temptation to cross that line is specific, seasonal and lucrative.

What six weekends does to a property’s status

Home football weekends produce the sharpest rate spike of any recurring event in inland Florida. A property that lets for a modest monthly figure on an academic lease can achieve several times its normal nightly equivalent across a handful of Saturdays.

The arithmetic is genuinely attractive. The regulatory consequence is that the property changes category.

The DBPR vacation rental licence test is met where a dwelling is rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays. Six weekends clears that comfortably. So does advertising the property for game weekends even if fewer bookings result, because the advertising limb of the test does not require the bookings to happen.

The tax follows immediately and without a threshold: every transient letting attracts the county’s 5% and the state’s 6%, from the first night, whether it is one weekend or twenty.

An owner planning to do both should therefore plan the compliance first: register with the county, register with the state, obtain the licence where the test is met, and treat the weekends as a licensed transient operation running alongside a residential tenancy rather than as an extension of it.

Where the collection gap opens

Airbnb collects and remits Alachua’s county tax on its own bookings. That covers a real share of weekend demand and nothing else.

Game-weekend lettings are unusually likely to be arranged directly, through alumni networks, returning visitors, colleagues and word of mouth. Those bookings carry no platform, no collection and no record beyond the owner’s own. They are also frequently the highest-value nights of the year.

Open a county account before the first transient letting and keep two figures each month:

Rent where nobody collected itdirect and other-channel bookings

The tax due is 5% of the second column. Confirm the filing frequency at registration and whether a zero return is required in months with no transient rent, which in this county will be most of them.

Underwriting a student rental properly

The academic model has its own arithmetic and it is not a standard 12-month tenancy dressed differently.

The year has a shape. Leases turn over on a fixed calendar, and a property not let by the start of the academic year is frequently not let at all that year. Vacancy is therefore lumpy: near zero or near total, rather than averaged.

Per-room letting changes the numbers. A 4-bedroom house let by the room typically grosses more than the same house let whole, at the cost of more administration, more turnover and more wear.

Wear is a real line, not a contingency. Budget for repainting and replacing soft furnishings on a shorter cycle than a family let would need.

Guarantors and deposits do the credit work. The tenant’s own income is rarely the security; the arrangement behind it is.

Ask for 3 years of actual occupancy and achieved rent for comparable properties at the same distance from campus, and for the actual turnover and maintenance spend across those years. Distance from campus moves rent measurably, and it is the variable most often estimated rather than measured.

City limits decide the local rules

Establish whether the property sits inside the City of Gainesville or in unincorporated Alachua County, because that answer decides which local registrations, inspections and enforcement apply. It is not always obvious from an address, and it is settled by the property appraiser’s record for the folio.

Under Florida Statute 509.032(7)(b), a local government may not prohibit vacation rentals or regulate the duration or frequency of stays by an ordinance adopted after 1 June 2011, while pre-2011 rules survive and may be amended only to become less restrictive.

Local government retains a great deal regardless: registration and inspection programmes, and generally applicable rules on noise, parking, waste, occupancy limits and life safety. In a university city, occupancy limits and parking rules are enforced actively and they bear directly on a per-room letting model.

Private restrictions sit outside preemption altogether. See the HOA and association restrictions checklist.

Financing

Lenders price a letting purchase differently from a second home, so state the intended use at application. Conventional investment lending, a DSCR loan underwritten on the property’s own income, or cash are the usual routes, and overseas buyers work through foreign national mortgage programmes.

A student rental has one underwriting advantage: signed leases with guarantors are strong evidence of income, and the academic calendar makes the income predictable. Bring the leases where a DSCR loan is the route.

Before you buy in Alachua County

  • Decide the model first: 12-month lease, transient letting, or both, and price the compliance accordingly.
  • Where any transient letting is planned, register with the county before the first booking.
  • Register with the state for sales tax on transient rentals separately.
  • Establish whether the DBPR vacation rental licence test is met, including the advertising limb.
  • Track platform rent and direct rent as two separate figures.
  • Confirm from the folio whether the property is in Gainesville or unincorporated Alachua.
  • Check occupancy limits and parking rules before assuming a per-room model works.
  • Get 3 years of actual occupancy, rent, turnover and maintenance for comparable properties.
  • Read any association documents, which can restrict letting more tightly than the city.

Where this leaves an investor

Alachua is a steady, calendar-driven rental market where the default model carries almost no regulatory burden and the high-yield exception carries all of it. That is an unusual and useful position, because it means the compliance question is a choice rather than a condition of ownership.

Make the choice deliberately. An owner running 12-month leases needs none of this page. An owner adding six weekends needs all of it, and needs it before the first Saturday rather than after the season. For neighbouring inland markets see Marion County and Citrus County.

Frequently Asked Questions

5% on lodging of 6 months or less. Alachua is a county-collected jurisdiction, so the tax is reported and remitted directly to the county, and it is one of the counties for which Airbnb collects and remits the county tax on its own bookings.

No. The transient taxes attach to lodging of 6 months or less, so a genuine 12-month written lease sits outside them entirely, along with the state vacation rental licensing test. That is why the dominant rental model in this county carries none of this administration.

A 2-night letting is transient in every sense: county tourist tax, state sales tax and, once the property is let more than 3 times a year for periods under 30 days or advertised as regularly available, the DBPR vacation rental licence. A handful of weekends a year is enough to change the property's regulatory status.

Yes, and many owners do, but the two models are taxed and licensed differently and the property cannot be half in and half out. Where any part of the year is let transiently, the transient obligations attach to that part, and the licensing test looks at the pattern of use across the calendar year.

For its own bookings, yes. Alachua appears among the Florida counties where Airbnb collects and remits county tourist development tax. Bookings taken directly or through other channels remain the owner's obligation, which matters most on game weekends when direct arrangements are common.

Establish first whether the property sits inside city limits or in unincorporated Alachua County, because the answer decides which registrations and inspections apply. City requirements sit on top of county tax registration and the state licence rather than replacing either.
