Quick answer: The administrative answer here is short: register the rental with the Town annually, open a Lee County tourist tax account, and hold a state licence where the transient test is met. The difficult answer is physical. Ian made landfall on this island in 2022, and the single most consequential thing about any property here is now what was rebuilt, to which code, and at what elevation. That question is answered by permits, not by photographs.
Three registrations, three authorities
| Layer | Requirement | Renewal |
|---|---|---|
| Town of Fort Myers Beach | rental property registration | annual, fees set by council resolution |
| Lee County | tourist development tax account | ongoing filings |
| State of Florida | DBPR vacation rental licence, on the transient test | periodic |
| State of Florida | sales tax registration for transient rentals | ongoing filings |
Owners arriving from counties with a single registration commonly obtain one and assume the others followed. They do not. Keep a record of all four with issue and renewal dates, and diarise the renewals, because the town registration in particular is annual and lapses quietly.
Confirm the current fees, forms and any inspection requirement directly with the Town, since municipal programmes change more often than state ones and a summary ages quickly. Expect the Town’s Good Neighbor style requirements around noise, waste, parking and occupancy to sit alongside the registration.
The document set that actually matters
A great deal of this island’s building stock was damaged, repaired or replaced after 2022. That is not history; it is the reason two properties on the same street can carry entirely different costs and entirely different risks.
Ask for documents rather than descriptions:
| Document | What it answers |
|---|---|
| Permit history for the parcel | what was rebuilt, when, and to which code |
| Roof age and material, with permit | the largest single insurance variable |
| Elevation certificate | flood zone, base flood elevation, premium |
| Substantial improvement or damage determinations | whether the structure had to be brought to current standards |
| 3 years of insurance premiums | the real cost line, not a rate applied to value |
| Claims history on the property | what an underwriter will see |
The substantial improvement question deserves particular attention. Where a structure’s damage or improvement crosses a defined threshold of its value, floodplain rules can require the whole building to be brought up to current elevation and construction standards. A property that went through that process is a different asset from one that did not, and the paperwork says which.
Rebuilt stock and repaired stock price differently
A structure rebuilt to current code at a compliant elevation presents differently to an underwriter than an older neighbour that was repaired in place. On a barrier island where wind and flood premiums are the largest operating cost, that difference can outweigh a meaningful gap in nightly rate.
So the sensible order of diligence here is inverted from a normal market. Establish the insurance position first, from real quotes on the specific address and elevation, and only then decide what the property is worth as a rental. A pro forma built on rate and occupancy with an estimated insurance line is not a pro forma.
Get quotes rather than percentages, ask whether cover sits with a private carrier or the state-backed insurer of last resort, and on a condominium establish what the master policy covers and what an owner’s own policy must bridge. See the Citizens insurance guide and the 1 million dollar liability requirement.
The 5% and who remits it
| Component | Rate | Who remits it |
|---|---|---|
| Florida state sales tax on transient rentals | 6% | commonly the platform, on its own bookings |
| Lee discretionary sales surtax | county surtax, where levied | with the state component |
| Lee County tourist development tax | 5% | Airbnb on its bookings; the owner on everything else |
Lee is county-collected and Airbnb collects for its own bookings. Direct bookings, other channels and any arrangement made through a local rental manager outside a platform remain the owner’s to collect and remit.
Open the county account before the first booking, whatever the channel mix, and keep two figures each month: rent where a platform collected the county tax and rent where nobody did. Confirm the filing frequency and whether a zero return is required in months without bookings. See Lee County.
What the Town may and may not do
Under Florida Statute 509.032(7)(b), a local government may not prohibit vacation rentals or regulate the duration or frequency of stays by an ordinance adopted after 1 June 2011, and pre-2011 rules survive and may be amended only to become less restrictive.
The statute expressly contemplates registration and inspection programmes, which is the ground the Town’s registration occupies. It also leaves untouched generally applicable rules on occupancy, parking, noise and waste, which on a narrow island with properties close together are enforced through complaints and reach code enforcement quickly.
Establish permitted occupancy and lawful on-site parking for the specific property before advertising a capacity. Overstating either is the most common route to a first enforcement contact.
Private restrictions sit outside preemption entirely. See the HOA and association restrictions checklist.
Where the 6-month line falls
The county tourist tax and the state transient sales tax both attach to lodging of 6 months or less. A single written lease running longer sits outside the transient regime: no county tax, no transient sales tax, no vacation rental licence and no filing calendar.
On a rebuilding island there is a real market for that model. Longer tenancies to households and workers connected with the recovery behave nothing like holiday demand: they are indifferent to season, arranged directly, and measured in months.
Model both. A 7-month or 12-month tenancy at a lower monthly figure competes seriously with a nightly operation once 5% county tax, 6% state tax, platform commission, cleaning, turnover vacancy and licensing come out of the nightly column, and it carries far less operational risk while a market is still normalising.
Financing
Lenders price a letting purchase differently from a second home, so state the intended use at application. Conventional investment lending, a DSCR loan underwritten on the property’s own income, or cash are the usual routes, and overseas buyers work through foreign national mortgage programmes.
Expect the lender and the insurer to want the same documents you should already be collecting: permits, roof age, elevation certificate and claims history. On a condominium, add the project questionnaire early, because reserve funding and any post-storm assessment history are exactly what a project review examines.

Where this leaves an investor
Fort Myers Beach is a recovering market with a genuine visitor economy and an unusually wide spread between properties that look similar. The rules are straightforward and the registration is routine; the value and the risk both sit in the building file.
Read the permits before the listing photographs, get the insurance quote before the pro forma, and the rest of this market behaves like an ordinary Gulf coast beach purchase. For nearby markets see Sanibel and Captiva and Lee County.
Frequently Asked Questions
Yes. The Town of Fort Myers Beach requires rental properties to register with the Town, renewed annually, with fees set by council resolution. That is a town requirement sitting alongside Lee County tourist tax registration and, where the transient test is met, a state DBPR vacation rental licence.
5% on lodging of 6 months or less. Lee is a county-collected jurisdiction and it is one of the counties for which Airbnb collects and remits the county tax on its own bookings. Rent from other channels and direct bookings remains the owner's to collect and remit.
Everything documentary. Hurricane Ian made landfall here in 2022 and a great deal of the island's building stock was damaged, repaired or replaced. Ask for the permit history for the parcel, what was rebuilt and to which code, the roof age with its permit, the elevation certificate, and 3 years of insurance premiums and claims.
Often materially better, because a structure rebuilt to current code at a compliant elevation presents differently to an underwriter than an older neighbour that was repaired rather than replaced. That difference can be worth more to a rental model than a modest difference in nightly rate, and it is visible only in the paperwork.
Within the limits Florida Statute 509.032(7)(b) allows. A local government may not prohibit vacation rentals or regulate stay duration or frequency by an ordinance adopted after 1 June 2011, though rules in place on that date survive. Registration and inspection programmes remain available, as do generally applicable rules on occupancy, parking, noise and waste.
Yes, where the property meets the transient public lodging test: broadly a dwelling rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays. The state licence, the town registration and the county tax account are three separate requirements.
