Anna Maria Island STR Rules 2026: Street by Street

Holmes Beach runs a 7-night minimum in most neighbourhoods and 30 nights on the canals and Key Royale. The rule changes by street, not by island.

Quick answer: On Anna Maria Island the minimum stay is not an island rule, a county rule or a state rule. It is set city by city and, inside Holmes Beach, neighbourhood by neighbourhood: broadly 7 nights in most areas and 30 nights on the canals and Key Royale. Two houses a few streets apart can therefore run entirely different businesses. Manatee County’s 6% is the owner’s to remit; no platform collects it here.

Three cities on one island

CityPosition on the island
Anna Marianorth end
Holmes Beachcentre
Bradenton Beachsouth end

Each is a separate municipality with its own code, its own permitting and its own enforcement. All three sit inside Manatee County for tax purposes, so the tax answer is the same across the island and the letting rules are not.

The first diligence step is therefore to establish which city the parcel is in, from the property appraiser’s record rather than from an address, and then to ask that city what its code permits for the specific parcel.

Inside Holmes Beach, the rule changes by neighbourhood

This is the fact that distinguishes Anna Maria Island from almost every other Florida beach market. Holmes Beach does not apply one minimum stay across the city.

AreaTypical minimum stay
Most Holmes Beach neighbourhoods7 nights
Canal neighbourhoods30 nights
Key Royale30 nights

A 7-night minimum and a 30-night minimum are different businesses. The first is a weekly holiday let with a familiar Saturday-to-Saturday rhythm; the second is a monthly letting whose guests are seasonal residents rather than holidaymakers, at a very different rate per night and with very different marketing.

Two consequences follow directly.

Comparables must come from the same rule area. A canal house priced against weekly-let comparables a few streets away is priced against a different product.

The rule is part of the asset. When you buy a property in a 30-night area you are buying a monthly-letting business, permanently, and no amount of listing optimisation changes that.

Confirm the applicable minimum for the specific parcel with the city in writing. Do not rely on a neighbour’s listing, a rental manager’s summary or a platform’s calendar settings.

Why these rules stand

Florida Statute 509.032(7)(b) prevents a local government from prohibiting vacation rentals or regulating the duration or frequency of stays. The preemption carries a date: it does not reach any local law adopted on or before 1 June 2011.

The island’s communities had rules in place before that date. Those rules survive, and they may be amended only to become less restrictive. That is the entire legal explanation for why a Florida city can impose a 7-night or 30-night minimum in 2026 when a city elsewhere cannot adopt one at all.

An owner arriving from a permissive county sometimes assumes state law has swept these aside. It has not, and the grandfather clause is the single most important thing to understand here.

Preemption also leaves untouched registration and inspection programmes, and generally applicable rules on occupancy, parking, noise and waste, all of which these cities enforce actively.

The 6% is yours to remit

ComponentRateWho remits it
Florida state sales tax on transient rentals6%commonly handled by the platform
Manatee discretionary sales surtaxcounty surtax, where leviedwith the state component
Manatee County tourist development tax6%the property owner, directly to the county

Manatee is county-collected and is not among the counties for which Airbnb collects the county tax. Platforms commonly handle the state component only, which is what makes the gap invisible: the payout summary is accurate about the half it covers.

Counties reconcile platform booking data against their own registration and filing records, so the first notice is usually a letter covering the whole operating history, with interest and penalties on gross rent. Open the county account before the first booking and confirm the filing frequency and whether a zero return is required out of season. See Manatee County.

Longer minimums are not automatically worse

Owners often treat a 7-night minimum as a constraint to be regretted. Run the arithmetic before agreeing.

Take a property achieving 350 dollars a night with a turnover cost of 250 dollars covering cleaning, linen and consumables.

Minimum stayRevenue per bookingTurnover as a share of revenue
3 nights1,050 dollarsabout 24%
7 nights2,450 dollarsabout 10%
30 nights10,500 dollars at the same nightly rateabout 2%

Nothing about the property changed. Longer stays also reduce wear, reduce complaints, reduce the administrative load and reduce the chance of a parking or occupancy breach reaching code enforcement.

The offset is rate: a 30-night letting will not achieve a peak-week nightly rate, and a 7-night minimum forecloses high-value weekend bookings around events. Model both properly for the specific property rather than assuming either direction.

Licensing

A DBPR vacation rental licence is required where the property meets the transient public lodging test: broadly, rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays.

A property in a 30-night area, let strictly on 30-night minimums, may fall outside the licensing test while remaining fully inside the transient taxes, because the licence line is 30 days and the tax line is 6 months. Confirm the position for the actual pattern of use rather than assuming the two move together.

Occupancy, parking and the complaint route

In a low-rise island market with houses close together, occupancy and parking rules are enforced through neighbour complaints, and complaints escalate quickly.

Establish the permitted occupancy and the lawful on-site parking capacity for the specific property before advertising a capacity. A house advertised for more people than it may lawfully sleep, or than it can park, generates exactly the complaint that brings code enforcement to the door in the first season.

Private restrictions can add another layer where a property sits in an association. See the HOA and association restrictions checklist.

Insurance

Wind and flood are normally written separately from the dwelling policy on this coast, and a letting operation needs liability cover written for that use.

Get real quotes for the specific address and elevation, ask the seller for 3 years of actual premiums, and get the flood zone and elevation certificate. On a low barrier island these are not formalities. See the Citizens insurance guide and the 1 million dollar liability requirement.

Financing

Lenders price a letting purchase differently from a second home, so state the intended use at application. Conventional investment lending, a DSCR loan underwritten on the property’s own income, or cash are the usual routes, and overseas buyers work through foreign national mortgage programmes.

Before you buy on Anna Maria Island

  • Establish which of the three cities the parcel is in, from the property appraiser’s record.
  • Get the applicable minimum stay for the specific parcel in writing from that city.
  • Draw comparables only from properties under the same minimum stay rule.
  • Model turnover cost at the applicable minimum before judging the rule.
  • Open the Manatee County tourist tax account before the first booking.
  • Confirm the filing frequency and whether zero returns are required out of season.
  • Establish whether the DBPR licensing test is met for your actual pattern of use.
  • Confirm permitted occupancy and lawful on-site parking before advertising a capacity.
  • Get the flood zone, elevation certificate and 3 years of real insurance premiums.

Where this leaves an investor

Anna Maria Island is a high-quality, low-density beach market whose rules reward a buyer who reads a map before reading a listing. The minimum stay attached to a parcel is a permanent feature of the asset, it varies within a single city, and it determines which business you are buying.

Get that one answer in writing before the offer and everything else here is ordinary coastal diligence. For the county-level position see Manatee County, and for the market to the south Sarasota County.

Frequently Asked Questions

It depends on the city and, within Holmes Beach, on the neighbourhood. Most Holmes Beach neighbourhoods run a 7-night minimum, while canal neighbourhoods and Key Royale commonly run 30 nights. Anna Maria and Bradenton Beach set their own positions. Establish the rule for the specific parcel with the relevant city before offering.

Three: Anna Maria at the north end, Holmes Beach in the middle and Bradenton Beach at the south. Each is a separate municipality with its own code and its own enforcement, and all three sit inside Manatee County for tax purposes.

Florida Statute 509.032(7)(b) bars local prohibitions and local regulation of stay duration or frequency only for ordinances adopted after 1 June 2011. Rules already in place on that date survive and may be amended only to become less restrictive, which is why several island communities keep minimum stay rules a city could not adopt today.

6% on lodging of 6 months or less. Manatee is a county-collected jurisdiction and is not among the counties for which Airbnb collects and remits the county tax, so the 6% is the owner's obligation to register for and remit.

Not necessarily. Longer minimum stays cut turnover count sharply, and turnover cost is the largest controllable line in a beach rental. A 7-night minimum in a market that books by the week can produce better net income than a 3-night minimum in a market that books by the weekend.

Yes, where the property meets the transient public lodging test: broadly a dwelling rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays. A property let on a strict 30-night minimum may fall outside the licensing test while remaining inside the transient taxes.
