Monroe County STR Rules 2026: Key West 28-Day Floor

Unincorporated Monroe bans rentals under 28 days. Only five land use districts can hold a vacation rental permit, and the permit is what you are buying.

Quick answer: In most of the Florida Keys you are not buying a house that happens to earn nightly rent. You are buying a permit that is attached to a parcel, in a place where the county has closed the door to new ones across most of its residential land. Underwrite the entitlement first and the building second, because the building can be replaced and the entitlement usually cannot.

Every other county in this state answers the question “can I rent this nightly?” with a process. Monroe answers it with an inventory. The scarce thing in the Keys is not beachfront and not construction labour, it is legal permission to host a guest for less than a month, and that permission was frozen into a map years ago.

This changes what due diligence means. Elsewhere you confirm that a property can be brought into compliance. Here you confirm that a property already holds something that cannot be created.

Why the entitlement outlives the building

A Keys house is a depreciating asset in a hurricane corridor. Roofs, docks, elevated construction, insurance, all of it can be rebuilt or repriced. What cannot be reconstructed after a loss is a permission the county has stopped issuing in your zoning district.

That inverts the usual order of underwriting. On a mainland deal, a buyer prices the structure and treats licensing as a cost of doing business, typically a few hundred dollars and a few weeks. In unincorporated Monroe, licensing is the constraint that decides whether the income model exists at all, and the structure is the part you can fix with money.

Two practical consequences follow. Sellers who hold a permit price it into the ask, sometimes without itemising it, which is why comparable square footage in the same neighbourhood can differ by a wide margin. And a buyer who intends to demolish and rebuild has to establish, in writing and before closing, what happens to the entitlement during the period when no dwelling exists.

Which land use districts can hold a vacation rental

Monroe assigns every unincorporated parcel to a land use district, and the district decides whether a Special Vacation Rental permit is even available. This is the map that matters more than the flood map.

Land use districtVacation rental permit
Suburban Residential (SR)Permit available
Mixed Use (MU)Permit available
Urban Residential (UR)Permit available
Improved Subdivision Vacation Rental (IS-V)Permit available
Offshore Islands (OS)Permit available
Improved Subdivision (IS)Unlawful under 28 days
Improved Subdivision Masonry (IS-M)Unlawful under 28 days
Urban Residential Mobile Home (URM)Unlawful under 28 days

The trap is that Improved Subdivision is the ordinary residential designation across much of the Keys. A canal-front home on a quiet street in a subdivision is exactly the property a visiting buyer wants, and exactly the property that cannot legally take a weekly booking. The listing photographs do not tell you which side of that line the parcel sits on.

Check the designation on the county property appraiser map before the inspection period, not after. A parcel in a closed district is not a compliance project, it is a different business.

What 12.5% is actually made of

The tax stack in the Keys is quoted loosely and often wrongly. It is worth separating, because the two components have different filing homes and different triggers.

ComponentRateApplies to
Florida state sales and use tax as applied in Monroe7.5%Transient rent
Monroe County Tourist Development Tax5%Stays of six months or less
Combined on gross rentabout 12.5%

Note the six-month reach of the county tax. The licensing question turns on 30 days, and the tax question turns on six months, so a property operating perfectly legally on monthly leases can still owe tourist development tax. Owners who moved to 28-day minimums to comply with the zoning floor sometimes assume they have left the tourist tax behind. They have not.

Platforms usually collect and remit on bookings made through them. That does not remove the owner’s registration obligation, and it does not cover a direct booking taken by email.

Where the city line changes the answer entirely

Monroe County contains five incorporated municipalities, and county land use districts do not govern inside them. Key West, Marathon, Islamorada, Layton and Key Colony Beach each set their own transient rental ordinances, licence counts and enforcement postures.

This produces a specific failure mode. A buyer reads that unincorporated Monroe requires 28 days, assumes the whole island chain works that way, and either walks away from a compliant Key West property or, worse, buys an unincorporated parcel believing a city rule applies to it. Postal addresses do not follow municipal boundaries reliably in the Keys.

Establish jurisdiction as step one. Everything downstream, the permit availability, the inspection regime, the licence transfer mechanics, depends on which government actually has authority over the parcel.

Pros and cons of buying into a capped market

The advantages of scarcity and the disadvantages of scarcity are the same fact seen from two sides.

Advantages. Supply cannot chase demand, so a permitted property competes against a fixed field rather than an expanding one. Nightly rates in the Keys hold up through cycles better than in markets where any owner can enter. The permit itself is a durable, transferable asset that supports resale pricing.

Disadvantages. Entry pricing already reflects the scarcity, so the yield on cost is thinner than headline nightly rates suggest. Insurance in a wind-exposed island chain is expensive and volatile. And the same rules that protect your income can be tightened further, since a county that has already restricted transient use has demonstrated the political appetite to do it again.

The honest summary: this is a capital preservation market wearing a yield market’s clothing.

Red flags on a Keys listing

Some of these are visible in the advert, and some only appear when you ask.

  • A nightly rate advertised for a parcel in an Improved Subdivision district. Advertising a stay the parcel cannot legally host is itself an enforcement trigger.
  • A seller who describes the licence as “grandfathered” without producing the permit number and its current status.
  • Historic booking revenue presented without the corresponding tourist development tax filings. If the income was real and the filings are missing, the liability is real too.
  • A permit whose annual inspection or renewal has lapsed during a rebuild or a sale process.
  • An HOA or condominium document that imposes a minimum stay longer than the county’s, which is permitted and is not disclosed on the listing.

Our insider tip: ask for the tax filing history before you ask for the booking history. Filings are made to a government under penalty, booking screenshots are made in a spreadsheet, and the two together tell you whether the operation you are buying was ever what it claimed to be.

Which buyer this market actually suits

The buyer it suits. Someone acquiring a permitted, operating rental with clean filings, who is buying an entitlement and a location rather than a yield calculation, and who has the reserves to carry island insurance without the income being load bearing.

The buyer it does not suit. Someone planning to purchase in a residential subdivision and apply for permission afterwards. That path does not exist in the closed districts, and the plan fails after closing rather than before.

The buyer who should look at a different county. Someone whose model depends on adding supply, scaling to several units, or on nightly rate growth. Capped markets do not reward that. The Gulf coast counties covered in our Collier County STR rules and the metro market in our Miami-Dade STR rules allow entry on process rather than on inventory.

For the state-level licensing steps that apply everywhere, see our DBPR vacation rental licence guide. County tax rates are compared in tourist development tax by county, and the yield arithmetic behind these decisions is set out in our Florida rental yield guide. Frequently Asked Questions

Not unless the parcel holds a Special Vacation Rental permit. Outside the permitted land use districts, unincorporated Monroe sets a 28-day floor, and advertising a shorter stay is itself the violation.

Suburban Residential, Mixed Use, Urban Residential, Improved Subdivision Vacation Rental and Offshore Islands. Improved Subdivision, Improved Subdivision Masonry and Urban Residential Mobile Home cannot hold one.

About 12.5% of gross rent: 7.5% state sales and use tax as applied in Monroe County, plus the 5% county Tourist Development Tax on stays of six months or less.

No. Key West, Marathon, Islamorada, Layton and Key Colony Beach are separate municipalities with their own rental ordinances. County land use districts govern unincorporated parcels only.

Because the permit is scarce and attaches to the parcel. A seller with a transferable permit is selling an income right, and buyers price it separately from the structure.

Permits carry continuity conditions and annual obligations. A gap in licensing, tax filing or inspection can end the entitlement, and re-entry is not guaranteed in a district that is otherwise closed.
