Key West STR Rules 2026: The Transient Licence

In Key West the right to let short-term is a capped, property-attached licence. Without one the model is 30 days or more, and the licence carries its own value.

Quick answer: In Key West the right to let short-term is not something an owner acquires; it is something a property already has. Short stays require a transient rental licence, the number is capped, and the licence is tied to zoning and attaches to the property. Without one, the model is 30 days or more. That scarcity is why licensed properties trade at a premium, and why verifying the licence is the entire purchase decision.

The licence is part of the property’s value

Almost everywhere else in Florida, a short-term rental purchase is a property purchase plus some paperwork. In Key West it is a property purchase plus a scarce, capped entitlement that cannot be manufactured.

PropertyWhat you can run
Holds a transient rental licencenightly and weekly letting, subject to the licence terms and zoning
Does not hold onelettings of 30 days or more

Because the stock of licences is capped, a licensed property and an unlicensed one of identical size, condition and location are not comparable assets and will not trade at the same price. The difference between them is the capitalised value of an income stream the second property cannot lawfully produce.

Two consequences follow for a buyer.

Never draw comparables across the line. A licensed property priced against unlicensed sold records looks expensive and is not; an unlicensed property priced against licensed records looks cheap and is not.

Verification is a contract condition, not a formality. Confirm in writing with the city that the licence is current, in good standing, correctly recorded against the property and will carry to a new owner. Make completion conditional on that confirmation. A seller’s assurance, a listing description and a booking history are not verification.

Do not plan on obtaining one

The cap is the point of the system. Treat the answer to “can I apply for one” as no unless the city tells you otherwise in writing for your specific property and zoning.

Buyers occasionally purchase an unlicensed property on the expectation of converting it, and that expectation is the most expensive assumption available in this market. Conversion of ordinary housing to transient use is deliberately difficult, and a capped system exists precisely to prevent it happening at scale.

Where nightly letting is the objective, the search should be filtered on licence status from the first day rather than treated as a detail to resolve later.

Why the regime stands

Florida Statute 509.032(7)(b) prevents a local government from prohibiting vacation rentals or regulating the duration or frequency of stays. The preemption carries a date: it does not reach any local law adopted on or before 1 June 2011.

Key West’s rules predate that line. They survive, and they may be amended only to become less restrictive. That is the whole legal explanation for a capped licensing system operating in a state that otherwise protects vacation rentals broadly.

The same clause explains Miami Beach and several other long-established Florida communities. Where you find an unusually restrictive local rule in this state, the explanation is almost always the ordinance’s date.

Preemption also leaves untouched registration and inspection programmes, and generally applicable rules on occupancy, parking, noise, waste and life safety, all of which are enforced actively in a dense historic city where properties adjoin one another.

The 5% is yours to remit

ComponentRateWho remits it
Florida state sales tax on transient rentals6%commonly handled by the platform
Monroe discretionary sales surtaxcounty surtax, where leviedwith the state component
Monroe County tourist development tax5%the property owner, directly to the county

Monroe is county-collected and is not among the counties for which Airbnb collects the county tax. Platforms commonly handle the state component only, and the payout statement is accurate about that half while saying nothing about the other.

Counties reconcile platform booking data against their own registration and filing records. The first notice is usually a letter covering the whole operating history, with interest and penalties on a figure calculated from gross rent. In a market with high nightly rates, that figure compounds quickly.

Open the county account before the first booking, and confirm the filing frequency and whether a zero return is required in quiet months. See Monroe County and tourist development tax by county.

The 30-day model is a real business here

An unlicensed Key West property is not an unrentable one. Lettings of 30 days or more are available, and in this city they have genuine demand: seasonal residents, longer-stay visitors, and people working in a market where housing is expensive and scarce.

ModelTermLicence requiredTax position
Nightly and weeklydaystransient licencetransient
Monthly letting30 days or moreno transient licencetransient, under 6 months
Seasonal tenancy3 to 5 monthsno transient licencetransient, under 6 months
Long tenancyover 6 months, written leasenooutside the transient taxes

Note the third row, because it is where unlicensed owners most often accumulate liability. A 4-month seasonal tenancy needs no transient licence and is fully taxable, since the tax line is 6 months rather than 30 days. Owners let for a season, treat it as an ordinary tenancy, and never register.

Only a written lease running longer than 6 months leaves the transient regime entirely, taking with it the county tax, the state transient tax and the vacation rental licensing test.

The state licence is separate

A DBPR vacation rental licence is required where the property meets the transient public lodging test: broadly, rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays.

That is a state requirement and it is entirely separate from the city’s transient rental licence. Holding a state licence does not create a city entitlement, and it does not make a letting lawful that the city’s system does not permit. The city licence is the scarce one; the state licence is the routine one.

The association and the historic district

Two further layers apply in this city more than in most.

Private restrictions. Condominium and association documents can restrict letting far more tightly than the city, and they sit outside state preemption entirely. Read the recorded declaration with amendments before offering. See the HOA and association restrictions checklist.

Historic district requirements. Much of the city’s housing stock sits within historic designations that govern exterior alterations, materials and works. That affects renovation timelines and costs rather than letting rights, but it belongs in the purchase budget, and it should be established before an offer rather than after a contractor’s first visit.

Insurance in the Keys

Wind and flood cover in Monroe County are among the most expensive in Florida and are normally written separately from the dwelling policy. A letting operation needs liability cover written for that use.

Do not estimate this line from a percentage. Get real quotes for the specific address and elevation, obtain the flood zone and elevation certificate, ask the seller for 3 years of actual premiums and the claims history, and establish whether cover sits with a private carrier or the state-backed insurer of last resort. See the Citizens insurance guide and the 1 million dollar liability requirement.

Financing

Lenders price a letting purchase differently from a second home, so state the intended use at application. Conventional investment lending, a DSCR loan underwritten on the property’s own income, or cash are the usual routes, and overseas buyers work through foreign national mortgage programmes.

On a licensed property a DSCR loan can work well, because the income is documented and the licence is durable. On a condominium, add the project questionnaire early, since reserve funding and owner-occupancy are project-level tests.

Before you buy in Key West

  • Establish whether the property holds a transient rental licence, in writing from the city.
  • Confirm the licence is current, in good standing and will carry to a new owner.
  • Make that confirmation a condition of the contract.
  • Do not plan on obtaining a licence for an unlicensed property.
  • Draw comparables only from properties on the same side of the licence line.
  • Open the Monroe County tourist tax account before the first booking.
  • Register any letting under 6 months, including seasonal tenancies.
  • Confirm the filing frequency and whether zero returns are required.
  • Get the flood zone, elevation certificate, 3 years of premiums and the claims history.
  • Establish any historic district requirements before budgeting renovation.

Where this leaves an investor

Key West is the clearest example in Florida of a market where an entitlement, rather than a building, is the scarce asset. The licence is capped, it attaches to the property, and it is priced into every licensed sale.

Buy the licence with the house or buy the house without it and run a 30-day business, but be clear which of the two you are doing before you offer. The unlicensed purchase made on a licensed assumption is the one mistake this market does not forgive. For the county-wide position see Monroe County.

Frequently Asked Questions

Only with a transient rental licence. Short-term letting in Key West is permitted where the property holds one, the number available is capped and they are tied to zoning. Without a transient licence the available model is lettings of 30 days or more. Verify the licence position for the specific property with the city before offering.

Treat the answer as no unless the city tells you otherwise in writing. The stock is capped, which is what gives an existing licence its value, and conversion of ordinary housing to transient use is deliberately difficult. The practical route to short-term letting here is to buy a property that already holds one.

The licence attaches to the property rather than to the owner, which is why licensed properties trade at a premium over otherwise comparable unlicensed ones. Confirm in writing with the city that the licence is current, in good standing and will carry to a new owner, and make that confirmation a condition of the contract.

Florida Statute 509.032(7)(b) bars local prohibitions and local regulation of stay duration or frequency only for ordinances adopted after 1 June 2011. Rules already in place on that date survive and may be amended only to become less restrictive, which is why Key West's long-standing regime continues to operate.

5% on lodging of 6 months or less. Monroe is a county-collected jurisdiction and is not among the counties for which Airbnb collects and remits the county tax, so the 5% is the owner's obligation to register for and remit.

Yes. The transient taxes attach to lodging of 6 months or less, so a 30-day or 90-day letting is fully taxable even though it sits outside the transient licence requirement. Only a written lease running longer than 6 months leaves the transient regime.
