New Smyrna Beach STR Rules 2026: The Zone Decides

Volusia bans lettings under 30 days in unincorporated areas and most residential zones. New Smyrna permits them only in designated zones, largely beachside.

Quick answer: In Volusia County the short-stay question is answered by a map, not by a licence. Lettings of less than 30 days are not permitted in unincorporated Volusia or in the residential zones of most incorporated cities, and New Smyrna Beach permits vacation rentals only in designated zones, concentrated beachside and broadly east of the Intracoastal Waterway. The total tax where letting is permitted is about 12.5%.

The zoning designation is the asset

Two houses in New Smyrna Beach, similar in size, age and condition, can support entirely different businesses because of which side of a zoning line they sit on. That difference is permanent, it is not visible from the street, and it is the first thing to establish on any purchase here.

Residential zones of most incorporated citiesnot permitted

The permitted areas are limited and sit largely beachside, broadly east of the Intracoastal Waterway. That is a description of where the permitted zones cluster, not a boundary you can rely on: the designation attaches to the parcel and the only safe source is the city.

Ask the city, in writing, two questions about the specific parcel: what its zoning designation is, and whether that designation permits vacation rentals. Take the folio from the property appraiser’s record rather than from a postal address.

A platform listing is not evidence. Platforms do not verify municipal zoning, and an unlawful listing can run for years before enforcement reaches it. The consequence of relying on one is not a fine and a correction; it is a purchase whose business model was never available.

Why the rules stand

Florida Statute 509.032(7)(b) prevents a local government from prohibiting vacation rentals or regulating the duration or frequency of stays. The preemption carries a date: it does not reach any local law adopted on or before 1 June 2011.

Volusia’s restrictions predate that line. They survive and may be amended only to become less restrictive. This is the entire legal explanation for a pattern that otherwise looks contradictory: a state that broadly protects vacation rentals containing counties where they are largely prohibited.

Preemption also leaves untouched registration and inspection programmes, and generally applicable rules on occupancy, parking, noise, waste and life safety.

The 12.5% and who remits it

ComponentRateWho remits it
Florida state sales tax and discretionary surtax6.5%commonly the platform, on its own bookings
Volusia County tourist development tax6%Airbnb on its bookings; the owner on everything else
Total on qualifying rentabout 12.5%

Volusia is county-collected and Airbnb collects for its own bookings. Direct bookings, other channels and any arrangement made outside a platform remain the owner’s to collect and remit, which requires a county account and returns whatever the platform is doing.

Open the county account before the first booking and keep two figures each month: rent where a platform collected the county tax, and rent where nobody did. Confirm the filing frequency and whether a zero return is required out of season. See Volusia County and tourist development tax by county.

If the zone says no, the purchase may still work

A negative zoning answer is not the end of the analysis. Two models remain and both are real in this market.

ModelTermCity positionTax position
Monthly letting30 days or moreoutside the short-stay restrictiontransient, under 6 months
Seasonal tenancy3 to 5 monthsoutside the restrictiontransient, under 6 months
Annual or long tenancyover 6 months, written leaseoutside the restrictionoutside the transient taxes

New Smyrna Beach carries genuine seasonal demand from long-stay visitors, and the beachside stock that cannot be let nightly can frequently be let monthly at a rate that survives the comparison once turnover costs come out.

Note the tax line carefully, because this is where owners in restricted markets accumulate quiet liabilities. A 30-day or 4-month letting complies with the zoning rule and is fully taxable, because the tax threshold is 6 months rather than 30 days. Only a written lease running longer than 6 months leaves the transient regime.

Licensing does not override zoning

A DBPR vacation rental licence is required where the property meets the transient public lodging test: broadly, rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays.

The licence is a state permission to operate a transient public lodging establishment. It is not a planning permission and it does not make a letting lawful that the city’s zoning prohibits. Owners occasionally treat a state licence as the senior authority; it is not, and holding one in a prohibited zone provides no protection at all.

The association layer

Private restrictions sit outside preemption entirely, and beachside condominium declarations in this market vary widely: minimums of 7 days, 30 days, 3 months or 6 months, caps on lettings per year, approval procedures and waiting periods after purchase.

An association can restrict further than the city and cannot permit what the city forbids. Read the recorded declaration with amendments before offering, and treat a seller’s summary as a starting point. See the HOA and association restrictions checklist.

Insurance and the coastal cost line

Wind and flood are normally written separately from the dwelling policy on this coast, and a letting operation needs liability cover written for that use. On a condominium, establish what the master policy covers and what an owner’s policy must bridge.

Get real quotes for the specific address and elevation, ask the seller for 3 years of actual premiums, and get the flood zone and elevation certificate. See the Citizens insurance guide and the 1 million dollar liability requirement.

Financing

Lenders price a letting purchase differently from a second home, so state the intended use at application. Conventional investment lending, a DSCR loan underwritten on the property’s own income, or cash are the usual routes, and overseas buyers work through foreign national mortgage programmes.

Where the zoning permits nightly letting, that permission is part of what you are buying and part of what the next buyer will pay for. Where it does not, underwrite the monthly or annual model and price the property as housing rather than as a rental business.

Before you buy in New Smyrna Beach

  • Get the parcel’s zoning designation and whether it permits vacation rentals, in writing from the city.
  • Confirm from the folio whether the property is in the city or unincorporated Volusia.
  • Where lettings under 30 days are not permitted, model the monthly and annual alternatives.
  • Register for the county tourist tax on any letting under 6 months, including seasonal tenancies.
  • Track platform rent and non-platform rent as separate figures.
  • Confirm the filing frequency and whether zero returns are required out of season.
  • Establish whether a DBPR vacation rental licence is required, and remember it does not override zoning.
  • Read the recorded declaration for minimum stays, caps and waiting periods.
  • Get the flood zone, elevation certificate and 3 years of real insurance premiums.

Where this leaves an investor

New Smyrna Beach is a genuine Atlantic coast destination with a restrictive county around it, and that combination makes the permitted zones scarce and therefore valuable. Property that can lawfully be let nightly is a different asset from property that cannot, and the market prices it accordingly.

The mistake to avoid is paying the first price for the second thing. One written zoning answer, obtained before the offer, settles it. For the county-level position see Volusia County.

Only in the zoning districts where the city permits vacation rentals, which are limited and concentrated beachside, broadly east of the Intracoastal Waterway. Lettings of less than 30 days are not permitted in unincorporated Volusia County or in the residential zones of most incorporated cities in the county.

Ask the city, in writing, for the zoning designation of the specific parcel and whether that designation permits vacation rentals. Take the folio from the property appraiser's record rather than working from an address, and do not rely on a neighbouring listing as evidence.

About 12.5% of qualifying rent: a 6% county tourist development tax plus 6.5% of state sales tax and discretionary surtax, on lodging of 6 months or less. Volusia is a county-collected jurisdiction and it is one of the counties for which Airbnb collects and remits the county tax on its own bookings.

Florida Statute 509.032(7)(b) preempts local prohibitions and local regulation of stay duration or frequency only for ordinances adopted after 1 June 2011. Rules in place on or before that date survive and may be amended only to become less restrictive, which is why long-standing zoning restrictions in this county continue to apply.

Then lettings of 30 days or more are the available model, and a written lease over 6 months takes the property outside the transient taxes and the vacation rental licensing test entirely. Both are viable in a market with strong seasonal demand, and both should be modelled before abandoning a purchase.

Yes, where the property meets the transient public lodging test: broadly a dwelling rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays. The state licence does not override city zoning, and holding one does not make a prohibited letting lawful.
