Quick answer: Panama City Beach runs a certificate regime, not a registration formality. Under Ordinance 1632 it is unlawful to rent or allow occupancy of a vacation rental without a valid Vacation Rental Certificate, obtained after a life-safety inspection, with required postings inside the unit. Add the county’s 5%, which applies only in listed postcodes and which no platform remits here, and a state licence, and you have three separate approvals to hold before the first guest.

The certificate is a precondition, not paperwork

Many Florida cities operate registration schemes where non-registration is a violation to be corrected. Panama City Beach’s ordinance is stronger than that: it makes renting or allowing occupancy without a valid certificate unlawful.

The distinction matters at two moments. At purchase, because a unit without a certificate is not currently lettable and the timeline to obtain one belongs in your diligence. And at inspection, because a unit that fails cannot be let until the issues are corrected and it is re-inspected, which in season is expensive.

The threshold that brings a unit into the regime is the familiar one: rented for less than 30 days, more than 3 times in a year. A property let only on longer terms sits outside it.

Plan the inspection into the purchase

The life-safety inspection is the step most likely to produce a surprise, because it looks at the physical unit rather than at paperwork.

Ask the seller three questions before the offer:

Does the unit currently hold a valid certificate? If yes, the inspection has been passed at least once and the standard is known.

When was it last inspected, and did anything require correction? A history of corrections tells you what the building’s stock typically needs.

What did the corrections cost and who did them? In a condominium, some items are the association’s and some are the owner’s, and the split is not always obvious.

Where the unit does not hold a certificate, budget both time and money for obtaining one, and do not commit to bookings before it is in hand.

Postcodes decide the county tax

Bay County’s 5% is not county-wide. The Department of Revenue’s schedule limits it to 32401, 32404, 32405, 32407, 32408, 32410 and the Bay County portion of 32413.

Panama City Beach sits inside that footprint, so for the market this page covers the tax applies. But the footnote is worth knowing for two reasons: it shows that a Florida county tax can be drawn geographically rather than by county line, and it means a Bay County purchase outside those postcodes needs the position confirmed rather than assumed.

ComponentRateWho remits it
Florida state sales tax on transient rentals6%commonly handled by the platform
Bay discretionary sales surtaxcounty surtax, where leviedwith the state component
Bay County tourist development tax5%, in the listed postcodesthe property owner, directly to the county

Bay is county-collected and is not among the counties for which Airbnb collects the county tax, and it is not administered by the Department of Revenue. Both automatic routes are closed.

That produces the standard quiet liability: the payout statement shows tax collected, truthfully, about the state component only. Counties reconcile platform booking data against their own registrations, and the first notice is a letter covering the full operating history with interest and penalties on gross rent.

Open the county account before the first booking, and confirm the filing frequency and whether a zero return is required out of season. See Bay County and tourist development tax by county.

Three approvals, three authorities

A DBPR vacation rental licence is required where the property meets the transient public lodging test, and it is entirely separate from the city certificate. Holding one does not satisfy the other, and neither satisfies the county tax registration.

Owners arriving from counties with a single registration frequently obtain one of the three and assume the rest followed. They do not. Keep a simple record of all three, with issue dates and renewal dates, and diarise the renewals.

What preemption leaves the city

Under Florida Statute 509.032(7)(b) a local government may not prohibit vacation rentals or regulate the duration or frequency of stays by an ordinance adopted after 1 June 2011, and pre-2011 rules survive and may be amended only to become less restrictive.

The statute expressly contemplates registration and inspection programmes, which is the ground Ordinance 1632 occupies. It also leaves untouched generally applicable rules on occupancy, parking, noise and waste, which in a high-density beach market are enforced actively through the summer.

Private restrictions sit outside preemption altogether. In a market dominated by large condominium buildings, the declaration is frequently the strictest document of all: minimum stays, letting caps, guest registration, amenity access and rental programme requirements. See the HOA and association restrictions checklist.

Underwriting a high-rise beach unit

Panama City Beach is a tower market, and the cost structure follows from that rather than from the nightly rate.

Association dues carry the building, including the master insurance that has repriced every year since 2022 on this coast. Ask for 3 years of dues history split into reserve contribution and master insurance premium.

Assessments are a live risk on older stock. Ask what has been levied, what is pending and what has been discussed at board level in the last 24 months, and request the minutes.

Supply is deep. Hundreds of near-identical units compete in the same building, so no owner has pricing power and the market clears at whatever the most motivated listing accepts. Underwrite from achieved rates in the same building, not from asking rates.

Turnover cost is the controllable line. In a market with short average stays, minimum-stay settings move net income more than nightly rate does.

Insurance

Wind and flood are normally written separately from the dwelling policy here, and a letting operation needs liability cover written for that use. On a condominium, establish what the master policy covers and what an owner’s own policy must bridge.

Get real quotes for the specific unit and floor, ask the seller for 3 years of actual premiums, and establish whether cover sits with a private carrier or the state-backed insurer of last resort. See the Citizens insurance guide and the 1 million dollar liability requirement.

Financing

Lenders price a letting purchase differently from a second home, so state the intended use at application. Conventional investment lending, a DSCR loan underwritten on the property’s own income, or cash are the usual routes, and overseas buyers work through foreign national mortgage programmes.

On a condominium, add the project questionnaire early. Reserve funding and owner-occupancy are project-level tests, and in a building dominated by let units the owner-occupancy figure is the one that moves.

Before you buy in Panama City Beach

  • Establish whether the unit currently holds a valid Vacation Rental Certificate.
  • Ask when it was last inspected and what required correction.
  • Budget time and cost for obtaining a certificate where none is held.
  • Open the Bay County tourist tax account before the first booking.
  • Confirm the filing frequency and whether zero returns are required out of season.
  • Register with the state for sales tax on transient rentals and obtain the DBPR licence.
  • Read the condominium declaration for minimum stays, letting caps and programme requirements.
  • Get 3 years of dues history split into reserves and master insurance premium.
  • Ask about assessments levied, pending or discussed in the last 24 months.
  • Underwrite from achieved rates in the same building, not asking rates.

Where this leaves an investor

Panama City Beach is a deep, well-established, high-volume short-stay market with unusually explicit local rules. The rules are not onerous; they are simply enforceable, and the certificate is a genuine precondition rather than a formality.

The two mistakes available here are buying a unit that cannot presently be let and assuming a platform is remitting a county tax it never touched. Both are answered before contract, one by the city and one by the county. For neighbouring markets see Walton County and Gulf County.

Frequently Asked Questions

Yes. Under city Ordinance 1632 every unit rented for less than 30 days more than 3 times a year must hold a valid Vacation Rental Certificate, and it is unlawful to rent or allow occupancy without one. The certificate process includes a life-safety inspection and required postings and signage inside the unit.

Broadly the fire and life-safety condition of the unit and its means of escape, together with the required postings. Book it early in the purchase timeline rather than after closing, because a unit that fails cannot lawfully be let until the issues are corrected and it is re-inspected.

5% on lodging of 6 months or less, and the Florida Department of Revenue schedule records that it applies only to postcodes 32401, 32404, 32405, 32407, 32408, 32410 and the Bay County portion of 32413. Bay is county-collected and is not among the counties for which Airbnb collects the county tax.

No. Bay does not appear on Airbnb's list of Florida counties where it collects and remits county tourist development tax, and it is not administered by the Department of Revenue. Platforms commonly handle the state component only, so the 5% is the owner's obligation.

Yes, where the property meets the transient public lodging test: broadly a dwelling rented more than 3 times in a calendar year for periods under 30 days, or advertised as regularly available for such stays. The DBPR licence, the city certificate and the county tax registration are three separate requirements.

The ordinance makes renting or allowing occupancy without a valid certificate unlawful, and enforcement runs through the city's code process. In a dense beach market with adjacent owners and managed buildings, an unpermitted operation is unusually visible.
